Accusations by Patrick Allemand against Christian Estrosi during the Nice Côte d’Azur Community Council

On June 25, 2010, the City Council of Nice appointed 2 additional delegates from the commune of Nice to sit on the Nice Côte d’Azur Urban Community. The Council of State, in its public session on December 9, 2011, annulled the electoral operations of June 25, 2010.

“Remember, you told me: ‘You are only seated there by my will. It is by my will that you are here.’ And I replied that we were not here by your will but by the law as soon as you joined the Urban Community. Well, the law has spoken. It has confirmed that your will was inferior to the law. It is reassuring in a State of Law.”

It is impossible that you yourself, your office, your administrative and legal services were unaware of what we knew!

You knowingly organized a denial of democracy. You harmed your opposition. You usurped two seats for 18 months.

I had informed you that the delegates from the commune to the Urban Community council should be elected by a one-round list vote according to the rules of proportional representation and that as the number of representatives from the city of Nice increased, it was appropriate to proceed with a new designation of all the delegates of the commune. I had explained to you in this situation what the law of local authorities was. But you forced your way through, proceeded only to the appointment of additional delegates, denying the principle of proportional representation governing all these designations.

On this occasion, you played the big shot.

That is to say, Mrs. Diouf and Mr. Calza, who are not to blame and who are respectable colleagues, have, due to your fault and will, occupied usurped seats in this community assembly.

It is precisely because it was your will, repeated many times, that you alone bear the political and moral responsibility for this denial of democracy of which we were the victims.

The political calendar’s coincidence means that we transition to the Metropole on January 1, 2012.

Ms. Frédérique Grégoire-Concas and Michèle Matringe will therefore never be community councilors, although they should have been sitting with us since June 2010.

This decision of the Council of State will set a precedent, but I express our determination to make the jurisprudence of this honorable institution prosper every time, based on your interests, you attempt to exempt yourself from the law.”
