1 – The new terms of the fixed-term contract
The Ordinance on the predictability and security of employment relationships now stipulates that the total duration of a fixed-term contract can be set by an extended branch agreement or convention. Specifically, an extended branch agreement or convention can indeed set a total duration exceeding 18 months. Furthermore, since September 24, 2017, the maximum number of possible renewals for a fixed-term contract can be set by an extended branch agreement or convention: the fixed-term contract can be renewed more than twice.
2 – The lending of workforce from a large group to startups
Article L8241-3 of the Labor Code will allow young companies to request groups with more than 5,000 employees to make their staff available to them.
Thus, young companies will be able to benefit from high-value-added skills without being hindered by the processes and costs of recruitment, and the issues of contract duration and termination.
